GENERAL RULES - updated from 2008 SE BookGENERAL RULES 1. The
Club is open until 11:00 p.m. Sunday through Thursday from Opening Day until
the end of the Frostbite Series. On Friday and Saturday evenings, the Club is
open until 12:00 a.m. 2. Members
shall conduct themselves properly while on the Club premises and shall be responsible
for any breakage or other damage to Club property or to the property of other
members caused by themselves, members of their households, or their guests. The
behavior of children is the responsibility of their parents. Children under 12
are not to be left unsupervised and must be accompanied by a related adult over
the age of 18. 3. Members
should be prepared to produce their membership cards or otherwise identify
themselves when requested to do so by a Club Officer, the Operations Manager,
or Club security personnel. 4. Guest
privileges will be afforded only to a person who is crewing on a Club yacht, is
in the company of a member, has a guest card, is aboard a visiting yacht, or is
a visitor from a recognized yacht club. No person may visit the Club as a guest
on more than three occasions during one season, other than when crewing on a
yacht at a Club regatta. During regattas no member may invite more than two
guests, other than crew members, because of the physical limitations of the
Club. Members shall be responsible for ensuring that their guests are aware of
and abide by all Club rules. 5. Smoking
is not permitted inside any Club building. 6. No
one under 21 years of age shall drink alcoholic beverages on the Club grounds
and storage of alcoholic beverages in the refrigerators, cupboards and like
places is not permitted. 7. The
second floor of the Fishing Bay clubhouse is intended for the use of ìadults
onlyî at all times. Children may not go upstairs unless accompanied by a parent
or an adult over the age of 21 who is clearly responsible for them. Children
and/or members who violate this or any other rule are subject to having their
names posted as a banned member. As long as any name remains posted, that
person will be banned from the use of the specified facility. 8. Dogs
are not allowed on the Club grounds unless leashed, and then only
to allow them to be taken to a boat. Dogs are not allowed in any building or in
any public area. Owners should be prepared to clean up promptly after their
dogs. 9. Except
in an emergency or for special situations as determined by a Club Officer or
the Operations Manager, there will be no sleeping in the clubhouse. 10. The kitchens may be used equally by all members
but there will be occasions during major events when members may be limited to
using one specific facility. The catering kitchen is to be used only with the
permission of the Social or Event Chair. Rules for the use of the kitchens are
posted in the three kitchen facilities. Members and visitors are expected to
clean up after using the kitchens by washing, drying, and putting away all of
the dishes and utensils used. Also, members and visitors are expected to clean
up any areas they use in the clubhouse, heads, pool and elsewhere on the Club
grounds. 11. To reduce usage of treated water, a 2-minute
limit is expected of all persons who use the showers. 12. To conserve electricity, turn off the lights
when leaving the clubhouses or the bathhouse at night. 13. Personal motorized watercraft, generally
referred to as Jet Skis, may not be launched, stored, beached or docked on FBYC
property. 14. The driveway in front of the clubhouse is
reserved for drop off and pick up of passengers and as an approach to the
launching ramp. Vehicles are not to be left unattended in this area except in
an emergency, in which case keys are to be left in the vehicle. Since parking
is at a premium close to the clubhouse, vehicle owners are requested to leave
space for others by parking only within designated spaces. 15. Parking of trailers for boats other than those
that have assigned spaces in the Small Boat Parking area is not permitted.
While boats that have been launched from the Club dock are in the water,
trailers may be left in the northeast corner of the Fishing Bay lot west of the
stables for no longer than 24 hours and must be detached from the towing
vehicle. 16. Parking on the Jackson Creek side of the Club
property is limited to the graveled areas and the Richardson field except when
this is posted. 17. No flammables are to be stored in the
clubhouse. KITCHEN
RULES
1. Member kitchens in Fannieís House
and the main clubhouse may be used equally by all members, while the intent is
that the catering kitchen in the main clubhouse will be used for Club events
except with permission of the Social or Event Chair. Rules for the use of the
kitchens are posted in the three kitchen facilities. 2. During major events, the catering
kitchen will be reserved for use by the Social or Event Chair responsible for the
specific event. Perishable items left in the refrigerator may be removed to
accommodate supplies for a Club event. 3. All food and containers left in
refrigerators/freezers should have a memberís name on them and be removed at
the end of a weekend or holiday. Food remaining in refrigerators in open
containers or food that is judged to be deteriorating will be disposed of by
the Operations Manager on Thursdays. 4. Persons using a refrigerator, stove
and/or dishes or glasses are expected to clean them and return dishes and
glasses to the location where they were previously stored. Also, the counter
space used must be cleaned. 5. Ice from the Club refrigerators is
not to be used to fill coolers. 6. Club supplies are not to be used
without permission from the Operations Manager or a Club Officer. Supplies,
which are used with permission, must be replaced the same day or paid for in
full. 7. No alcoholic beverages are to be
left in the kitchen in unlocked refrigerators or in unattended bags, coolers,
etc. Only alcoholic beverages for Club events may be stored in Club
refrigerators. POOL RULES 1. SWIM
AT YOUR OWN RISK. 2. No
swimming alone. 3. No
children under 6 years old without responsible person. 4. No
person under 16 years old in pool after 8:00 p.m. without accompanying adult
(at least 21 years old). 5. No
swimming after 10:00 p.m. 6. Members
and guests only. 7. No
solid food in pool area. Drinks only in non-breakable containers. 8. No
running. 9. One
person on diving board at a time. 10. FBYC not responsible for valuables. Club
management may dispose of items left over two weeks. 11. OBEY LIFEGUARD'S INSTRUCTIONS. Anyone not doing
so may be required by the lifeguard to leave the pool area. DINGHY AND
SMALL BOAT PARKING RULES
Long
term parking of enrolled dinghies and small sailboats is limited to members who
have completed a Request for Dinghy and Small Boat Parking/Rack Space form and
paid the appropriate fee. The Club does not rent parking spaces for powerboats.
Day storage for small boat trailers is restricted to the assigned boat storage
space and for powerboat trailers to the northeast corner of the Fishing Bay lot
west of the stables. Storage for small boats may be available on a short-term
basis, not to exceed 10 days, at the discretion of the One Design Division
Commander. Dinghies and small boats stored on FBYC property are subject to
being moved to an alternate space, in which event the owner will be advised by
the Docks Chairman or One Design Division Commander. 1. These rules document the
responsibilities of members who store a dinghy or small boat on a rack, dolly
or trailer on FBYC grounds. 2. Boats and dinghies stored on club
property must be 100% member owned. Each boat owner who rents a space shall
contact the One-Design Division Commander and each dinghy owner who rents a
rack shall contact the Docks Chairman to receive a space assignment. Each boat
owner shall store his boat and dolly or trailer only in the assigned space, and
spaces are not to be subleased. 3. All spaces are rented from January
1 through December 31. Any member who gives up a space is required to vacate
the space by December 31. If the boat and trailer are not removed by December
31, FBYC reserves the right to bill the member for the additional time that the
space is occupied. 4. All boats stored on racks, or
parked on dollies or trailers, shall be kept shipshape with spars secured,
covers tied down, halyards and gear properly secured or stored, and no parts
lying on the ground. Covers shall be made to fit the boat and tarpaulins are
not allowed. 5. The owner of any boat or trailer
left on the Club grounds longer than 10 days must be assigned a space, pay the
appropriate fee, and display a FBYC sticker. Members who store dinghies or
small boats for more than 10 days without explicit authorization from the Docks
Chairman or One Design Division Commander shall be billed for a minimum of six
months storage. 6. All trailer wheels shall be kept in
good condition and tires inflated so that each trailer can be moved when
required, either to mow the grass or to provide space for visiting boats at
major regattas. 7. The Docks Chairman and the
One-Design Division Commander shall notify any boat owner who fails to comply
with paragraphs 4-6 above and the boat owner is expected to correct the failure
within two weeks. If the owner fails to make the necessary repairs, the
Operations Manager will have them made at cost plus an appropriate service fee. 8. The only maintenance work allowed
on boats in the small boat parking area shall be minor routine maintenance that
does not have any impact on any adjacent boats. Absolutely no air or airless
spray painting or bottom painting is allowed. 9. Notwithstanding any of the
requirements listed above, members may be asked to remove their boats from Club
property if they are considered to be unseaworthy or eyesores. The decision on
whether or not a boat fails to meet the requirements for continued storage on
FBYC property will be made by the Fleet Captain and the Docks Chairman for
dinghies or by the Fleet Captain and the One Design Division Commander for
small boats. PIER RULES
1. These
rules establish the responsibilities of the owner and guests on each yacht,
including visiting yachts, at the FBYC piers. 2. The
owner of each yacht at the FBYC piers shall be responsible for all maintenance
of, security for, and storm damage to such yacht. FBYC shall have no such
responsibility. Current insurance shall be in force to cover liability for
damage to other boats and FBYC property. A current Lease Agreement, signed by
the owner or owners, and proof of insurance shall be on file with the Executive
Secretary for all boats berthed in slips. 3. All
owners and guests shall adhere to the Federal, State and local laws governing
disposal of sewage and trash. In addition, no one shall use the head facilities
on any boat tied up at the FBYC piers unless the boat is outfitted with a
holding tank. For violations, a penalty of $100 per occurrence shall be
assessed pursuant to a Resolution passed during the February 13, 1986 Board
meeting. 4. The
only maintenance work allowed on boats in slips shall be minor routine
maintenance by slip leaseholder or his sub-contractor that does not have any
impact on pier usage or on any adjacent slip occupants. Absolutely no air or
airless spray painting, bottom painting or bottom sanding is allowed. 5. Each
yacht owner who removes his yacht from the FBYC piers overnight or for an
extended period of time is requested to notify the Docks Chairman and the
Operations Manager by the most efficient means, preferably by telephone or
e-mail, of their departure and return dates. This will enable the Operations
Manager to know which slips are available for overnight use by visiting yachts. 6. All
dock lines: (a) must be of proper size and strength for
the yacht's displacement, (b) must be kept in good condition and lines that
are unraveling or chafing must be immediately replaced, and. (c) must be attached to the pier in such a
way that they are capable of being eased or adjusted from the pier in case of
high water, and be without any spliced loops or bowlines. Further, it is
recommended that all stern lines be crossed so that a yacht's lateral movement
is kept to a minimum. 7. All
halyards shall be secured so that they will not slap spars or other parts of
the rigging making unnecessary noise. 8. All
electric cords shall be hooked up in a manner so that they will not be a
hazard. 9. To
conserve our treated water for essential uses, such as showers and toilets,
nozzles and shut-off valves are to be used on the piers at all times. On
holiday weekends and during other periods of high club use, please use
restraint in washing boats. 10. Hoses left on the piers shall be coiled and
hung so as not to be a hazard. 11. For short absences during the sailing season
from opening day to closing day when a yacht will be absent from the slip for
more than two weeks, the slip holder must notify the Docks Chairman of the
duration the slip will be vacant so that the Docks Chairman may use the slip
for the benefit of the Club. 12. For long absences during the sailing season
from opening day to closing day when a yacht will be absent from the slip
assigned to the member for more than three months, the slip assignment may be
rescinded. In this event, the rent for the remainder of the year will be
refunded to the member who was assigned the slip, the Docks Chairman will place
his name on the Standby List, and the Docks Chairman will reassign the slip in
accordance with these rules. Alternatively, the slip may be held for the yacht
or the yachtís owner and the slip subleased by the Club with the proceeds going
into the general fund. 13. Children under 8 years of age and non-swimmers
must wear life preservers when on the piers. 14. Bicycle riding and running are prohibited on
the piers. 15. Notwithstanding any requirements listed above,
members may be asked to remove their boats from Club property if they are
considered unseaworthy or eyesores. Any decision on removal of boats is to be
made by the Flag Officers, Fleet Captain and the Docks Chairman. SLIP
ASSIGNMENT RULES
1. Requesting a Slip Assignment. A Club
member who owns an enrolled yacht, as described in Section 5 of the Bylaws,
that is of an appropriate size and who desires to rent a slip must submit a
written request to the Docks Chairman. If a slip of the proper size and depth
is available, the Docks Chairman will assign a slip pursuant to paragraph 5
below. 2. Waiting
List. (a) If no slip of the proper size and depth
is available when a member requests a slip, the Docks Chairman will place the
member's name on the Waiting List in the order of his date of request. As slips
become available, each member on the Waiting List will be assigned a slip in
the order of the member's date of request. (b) A member who owns at least 33% of an enrolled
yacht that is of an appropriate size for either a dry sail or wet slip may
either have a slip assigned to him, provided his co-owners are also Club
members, or have his name placed on the Waiting List. (c) A proposed member may not request a slip
assignment prior to his date of election to membership. 3. Priority
List. (a) A member, who has a slip but requires a
larger or deeper slip due to the purchase of a bigger yacht, will be placed on
a separate Priority List. When appropriate sized slips become available,
members on the Priority List will be assigned larger slips in the order of
their original dates on the Priority List. (b) A member on the Priority List will be given
preference over a member on the Waiting List. (c) A member on the Priority List who does
not receive a slip assignment in time to accommodate his new yacht when
delivered, may terminate his existing slip assignment and still remain on the
Priority List for a larger slip. 4. Standby
List. (a) There are certain situations when a
member does not want to rent a slip but expects to do so in the future. In any
of the following situations, the Docks Chairman will place the member's name
and the date the request was received on the Standby List: (i)
The member is a co-owner of at least 33% of a yacht that is in either a dry
sail or wet slip. The member's standby date will be either the date the member
submitted his request for a slip or the date he became a co-owner as described
above, whichever is earlier. (ii)
The member does not own an enrolled yacht that is of an appropriate size for
either a dry sail or wet slip but wants to acquire such a yacht and rent a slip
in the future. The member shall submit to the Docks Chairman a written request
to be placed on the Standby List (iii)
The member previously owned but does not currently own at least 33% of a yacht
that was in a dry sail or wet slip and wishes to be placed on the Standby List (iv)
The member's name comes to the top of the Waiting List but he declines to rent
a slip. The member's name will be moved from the Waiting List to the Standby
List and the member's standby date will be the date he submitted his request
for a slip. (v)
The member's yacht is absent from the slip assigned to the member for more than
three consecutive months and the member's slip assignment is rescinded under
paragraph 12 above (Pier Rules). The member's name will be placed on the
Standby List and the member's standby date will be the earliest date that the
member's yacht was in a dry sail or wet slip. (b) When a member whose name is on the Standby List
(i) has acquired at least a 33% interest in an enrolled yacht that is of an
appropriate size for either a dry sail or wet slip and (ii) wants to rent such
a slip, the member shall notify the Docks Chairman in writing. The Docks
Chairman either will assign a slip to the member, if one is available, or will
put the member's name on the Waiting List in order according to the member's
date of request, which shall be the same as his standby date. 5. Slip
Assignment. When a slip becomes available, the Docks Chairman will
assign the slip to the first person on the Priority List or Waiting List, in
accordance with these rules. The member shall advise the Docks Chairman within
five days after the slip is assigned whether or not he intends to accept such
assignment. A member who is assigned a slip shall have 30 days to accept the
slip, if it is of suitable size and depth, or longer if he can document that he
has a yacht on order at the time of assignment. 6. Slip
Rental. Slip rentals will be paid on an annual basis (January
1-December 31), except as follows. A member who anticipates occupying a slip
less than one year will pay the full annual rental and, upon notice to the
Docks Chairman that the slip has been vacated, will be reimbursed for the
remaining full months of the year after the date notice was given. A member who
is assigned a slip other than at the beginning of a year will be billed for the
portion of the year beginning with the month after the date of his assignment.
In the event that there are vacant slips and no one is on the Waiting List with
an appropriate sized yacht for the vacant slips, the Docks Chairman may at his
discretion, rent the vacant slips on a month-to-month basis. If a member
happens to be occupying two slips temporarily while in the process of selling
one of his yachts, he will make full payment for both slips, but will be
reimbursed on a pro-rata basis upon notification to the Docks Chairman when one
of his yachts is removed from the slip. 7. Use
By Members Only. Slips are for the use of members and
their yachts only and may not be subleased. In the event that a member sells
his yacht, he may retain possession of his slip if he can document that he has
a new yacht on order. The new owner of the original yacht, whether a member or
non-member, must vacate the slip within 30 days after the date of sale. Also,
if a yacht ceases to be enrolled, the slip must be vacated within 30 days. 8. Shifting
Assignments. (a) The Docks Chairman may shift slip
assignments when circumstances are such that a small yacht is occupying a
larger or deeper slip than necessary and there are larger yachts on the
Priority List. The end of the East Pier may be used as a slip as needed on a
temporary basis. (b) Members may not exchange slips without approval
of the Docks Chairman, and then only in the event there is no Priority List of
members requesting larger slips that would supersede such a swap. 9. Change
of Ownership. In the following situations regarding
the change of ownership or control of an enrolled yacht, the following actions
will be taken. (a) When the present slipholder's ownership
becomes less than 33%, the slip must be vacated. However, when the transfer of
ownership is within a membership or is from one membership to another and they
are related as parent and child, the slip request date of the new owner shall
be that of the original owner. (b) If enrolled status is granted on the basis of a
charter, that status shall cease when the charter expires and the yacht must be
removed from the slip immediately. 10. Moving Boats. In the
event a boat needs to be moved either as the result of an emergency or for
maintenance of the docks, dredging or any other need, the Club, at its
discretion, may move the boat to any other space. In this event, neither the
Club nor any of its officers, trustees, agents or employees shall have any
liability to the owner or owners or any other person for any loss or damage
resulting from such movement or from any failure to move the boat, whether
occurring by negligence or otherwise, and the member waives any rights against
the Club and its officers, trustees, agents, and employees by reason of such
emergency. 11. Rules Are Guidelines. It is
the intent of these rules to serve as guidelines for slip assignments. However,
any circumstances that are not explicitly covered will be reviewed by the Board
of Trustees for action as they see fit. DRY SAILING
AND LIFT FACILITY RULES
Purpose/Objective The
dry sailing and lift facility is provided to promote racing of small keelboats
with a maximum length of 30 feet and a beam of 11 feet. Exceptions may be made
on a per case basis, but will apply for only one year and will be subject to
annual review. The selection of the lift and layout of the dry sailing facility
is for boats 6000 lbs. or less. The lift and hoist are not to be operated for
any vessel over 6,000 lbs. Priority for launching on race days will be given to
racing boats with dry sail spaces. Rules 1. The lift shall be locked and
secured at all times when not in operation. 2. The lift shall be operated in a
safe manner at all times. Training will be available for first time users. It
shall be used only by members of FBYC who have paid the fees set by the Club
for use of the facility with the following exceptions: (a) With permission from the Operations
Manager or the Docks Chairman. (b) By a Fleet Measurer for the purpose of
measuring boats. If the Fleet Measurer is not a member of FBYC, an FBYC member
must assist him. (c) For invitational regattas approved by the
Board, subject to a trained operator supervising the activity. 3. Each user shall supply his own
lifting gear. 4. Each user shall be responsible for
his/her own boat, trailer and other property. FBYC shall have no responsibility
for maintenance of, security for, or storm damage to any yacht stored in the
dry sail lot. A current Lease Agreement, signed by the owner or owners, and
proof of insurance shall be on file with the Executive Secretary for all boats
stored in the dry sail lot. 5. The only maintenance allowed in the
dry sailing facility shall be minor routine maintenance by paid-up users of the
facility. No bottom maintenance of boats is allowed except washing. Absolutely
no painting or sanding is allowed on the boat's bottom due to environmental
regulations. 6. All boats shall be left on trailers
and shall be well kept and maintained. Any boat not actively used for one year
or that is considered to be an eyesore shall be removed from the area. The
Docks Chairman and the Fleet Captain will make the decision on whether or not
boats meet the requirements for continued storage on FBYC property. 7. Boats will be assigned a space as
it becomes available but are subject to relocation at any time to allow optimum
use of available space. Space in the dry sail area is leased on an annual basis
from January 1 through December 31. Any member who gives up a dry sail space is
required to vacate the space by December 31. If the boat and trailer are not
removed by December 31, FBYC reserves the right to bill the member for the
additional time that the space is occupied. 8. A priority waiting list will be maintained
for boats that race and a standby list for non-racing boats. VISITING
YACHT RULES
1. The skipper of a visiting yacht
must be a member of a recognized yacht club and must sign the FBYC guest
register. A copy of these Rules and the Pier Rules will be posted in the
screened porch adjacent to the Jackson Creek docks. By accepting a dock space,
visitors will be deemed to have acknowledged they have read and agree to be
bound by both the Clubís Pier Rules and Visiting Yacht Rules, particularly with
respect to limiting water usage. 2. No visiting yacht shall occupy a
slip on the Jackson Creek pier unless permission is obtained from the Docks
Chairman and/or the Operations Manager. 3. Visiting yachts shall not be
charged for the first 24 hours of stay in any 30-day period. 4. Thereafter, visiting sailing yachts
shall be charged $1.50 per foot per day and visiting power yachts shall be
charged $2.50 per foot per day for use of ANY Club facilities on a specific
date, or dates. However, no charge shall be made for dockage or the use of dry
sail facilities for a visiting yacht that has been invited by the Board to use
the Club facilities on a specific date, or dates, or for a yacht that is
participating in a FBYC race or series of races. |
